Regulatory framework plans

The Canadian Nuclear Safety Commission (CNSC) maintains a regulatory framework supported by 3 published plans. Together, these outline planned regulatory changes and long-term reviews, providing interested parties opportunities for input.

To ensure that the regulatory framework remains flexible, effective and relevant, the CNSC reviews and updates its regulatory instruments on a regular basis. There are 3 types of plans that guide the review of CNSC’s regulatory framework:

  1. The Forward Regulatory Plan (FRP) is a public list, required by the Cabinet Directive on Regulation, of planned or anticipated regulatory changes (regulatory initiatives) that the CNSC intends to propose or finalize within a 2-year period.
  2. The Regulatory Stock Review Plan (RSRP) is a public list, also required by the Cabinet Directive on Regulation, of planned reviews of regulations made under the Nuclear Safety and Control Act (NSCA) that the CNSC expects to carry out over a 10-year period.
  3. The Regulatory Framework Plan (RFP) captures regulations and regulatory documents that the CNSC plans to develop or amend, including those outlined in the RFP and RSRP. It aligns with CNSC's corporate priorities and, also considers current developments in the nuclear environment.

Updated yearly, these plans are intended to give individual Canadians, Indigenous Nations and communities, businesses and trading partners greater opportunity to provide input on the regulatory reviews and plan for the future.  For 2025–26, the CNSC has created one single unified plan, the Regulatory Framework Plan, to make it easier for interested parties to review upcoming regulatory work.

The table lists all current initiatives on August 12, 2025, under a single plan, which includes the FRP and the RSRP, outlining planned regulatory changes and multi-year review activities.

Nuclear Security Regulations – repeal and replace

Repeal and replace the Nuclear Security Regulations

Enabling act: Nuclear Safety and Control Act

This initiative proposes to repeal and replace the Nuclear Security Regulations to strengthen security at nuclear facilities and safeguard sensitive information. The changes aim to:

  • reflect new threats and risks to Canada’s nuclear sector
  • enable deployment of new reactor technologies
  • prioritize the advancement of small modular reactors (SMRs)
  • support performance-based regulation

The revised regulations will align with international obligations and guidance, including International Atomic Energy Agency recommendations. They will also incorporate lessons from past international peer reviews and update several related regulatory documents. First included in FRP in 2017.

Potential impacts: May affect businesses. The “one-for-one” rule and small business lens may apply.

Regulations Amending Certain Regulations Made Under the Nuclear Safety and Control Act (Imports, Exports and Safeguards)

Enabling act: Nuclear Safety and Control Act

This regulatory initiative proposes updates to the General Nuclear Safety and Control Regulations and Nuclear Non-proliferation Import and Export Control Regulations. The changes aim to:

Import/export controls

  • harmonize with international export control guidelines
  • streamline import/export procedures for low-risk items

Safeguards and information requirements

  • expand safeguards to all persons, not just licensees
  • modernize information requirements
  • align with national record retention requirements

The initiative supports Canada’s treaty commitments and introduces licence exemptions, clearer requirements and updated retention periods. First included in the FRP in 2016.

Nuclear Security – Bill C-21 implementation

Amendments to the Nuclear Security Regulations (Implementation of Bill C-21)

Enabling act: Nuclear Safety and Control Act

This initiative will update the Nuclear Security Regulations to support the implementation of Bill C-21 (An Act to amend certain Acts and to make certain consequential amendments to regulations). The changes will:

  • designate nuclear security officers as peace officers
  • establish a process for handling complaints related to their conduct when exercising these powers

Initial consultations on related policy issues were held in 2015. First included in the FRP in 2015.

Potential impacts: Strengthens oversight and accountability measures related to the designation of peace officer powers.

Canadian Nuclear Safety Commission By-laws

This regulatory initiative will review the Canadian Nuclear Safety Commission By-laws. These by-laws:

  • establish guidelines for Commission meetings and affairs
  • define the responsibilities of the Registry (formerly the Secretariat)
  • set requirements for quorum

These regulations apply to the CNSC, all nuclear facilities and CNSC licensees and applicants.
